Energy Facility Siting Council To Meet June 29 In Salem

SALEM — Rulemaking projects related to carbon dioxide emissions and solar photovoltaic facilities will be the main topics of discussion at the next Oregon Energy Facility Siting Council meeting on Friday, June 29 in Salem. The public meeting begins at 8:30 a.m. at the Oregon Department of Energy, 550 Capitol Street NE.

The main items on the Council’s agenda include:

  • Carbon Dioxide Rulemaking, Phase II: The Council will hold a hearing on the proposed rule amendments during agenda Item B, then under Item J will deliberate and decide whether to approve final rule language or provide additional direction to staff. The purpose of this rulemaking is to evaluate, and potentially modify, the Council’s CO2 emissions standards.
  • Potential Solar Rulemaking: Staff recommends a new rulemaking project regarding solar photovoltaic facilities. This rulemaking would:
    • evaluate whether multiple non-EFSC jurisdictional solar photovoltaic facilities could aggregate in a way that the aggregate is functionally the size of an EFSC jurisdictional facility, and, if yes, develop new rules that identify objective criteria and a process for determining when multiple non-EFSC-jurisdictional facilities do aggregate to the size as a single EFSC-jurisdictional facility, and must therefore seek a site certificate; and
    • evaluate whether specific standards should be developed for the siting of solar photovoltaic facilities, and if so, develop such standards.
  • Wheatridge Wind Energy Facility, Request for Amendment 2 (Morrow and Umatilla counties): The certificate holder has requested the Council review staff’s determination that Request for Amendment 2 must go through the Type A amendment review process, which includes potentially longer timeframes, a public hearing in front of Council, and an opportunity for someone to request a contested case. The certificate holder believes Amendment 2 is appropriate for the Type B process, which includes potentially shorter timeframes, no public hearing in front of Council, and no opportunity for someone to request a contested case. The Council will allow oral comment from the certificate holder and members of the public.
  • Golden Hills Wind Project, Request for Amendment 5 (Sherman County): The certificate holder has requested the Council review staff’s determination that Request for Amendment 5 must go through the Type A amendment review process, which includes potentially longer timeframes, a public hearing in front of Council, and an opportunity for someone to request a contested case. The certificate holder believes Amendment 5 is appropriate for the Type B process, which includes potentially shorter timeframes, no public hearing in front of Council, and no opportunity for someone to request a contested case. The next EFSC meeting is tentatively scheduled for August 23-24 in Boardman.
